Terms and conditions of carriage When requesting SLD EXPRESS services, you, as the “owner of the shipment”, agree, on your behalf and on behalf of the recipient of the shipment (the “recipient”) and any other person who has an interest in the shipment to which these terms and conditions apply. “Shipment” means all documents or parcels transported under a single bill of lading, and which can be made by any method chosen by SLD EXPRESS including air, land or any other carrier.   • 1- Customs Clearance SLD EXPRESS may perform any of the following activities on behalf of the owner of the shipment or the recipient to provide its services:
    • Complete any documents, amend product or service codes, and pay any fees, taxes or penalties required by applicable laws and regulations (“Customs Duties”).
    • Acting as a freight agent for the shipper for customs and export control purposes and as a receiver only for the purpose of appointing a customs broker to perform customs clearance and entry.
    • Re-direct the shipment to the recipient's customs broker or another address upon request by anyone whom SLD EXPRESS believes is authorized.
  • 2- Unacceptable shipments A shipment is considered unacceptable if:
    • No customs declaration was issued upon the applicable customs regulations.
    • It contains counterfeit goods, animals, bullions, currency, and gems. Weapons, explosives and ammunition; Human remains, illegal items such as ivory and drugs.
    • Classified as Dangerous Goods, Dangerous Goods, or Articles Banned or Restricted by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization) or ADR (European Regulation for Road Transport on Dangerous Goods (or any other related organization) Dangerous').

  • 3- Deliverable and non-deliverable items:

  • 7- Inspection SLD EXPRESS has the right to open and inspect a shipment without prior notice for safety, security, customs or other regulatory reasons.

  • 9- SLD EXPRESS Obligations 1.   • 10- Claims All claims must be submitted in writing to SLD EXPRESS within thirty (30) days from the date of acceptance of SLD EXPRESS for shipment, if SLD EXPRESS bears no liability whatsoever.Claims are limited to one claim per shipment, which will be a full and final settlement of all losses or Damages related to it.
  • 11-Shipping insurance SLD EXPRESS may be able to arrange insurance covering the value in connection with loss or damage to the shipment, provided that the shipper sends this to the SLD EXPRESS in writing, including by completing the insurance section at the front of the bill of lading or by means of automated SLD EXPRESS systems and the applicable premium is paid . Shipping insurance does not cover indirect loss or damage, or loss or damage caused by delays.
  • 12-Circumstances beyond the control of SLD EXPRESS SLD EXPRESS shall not be liable for any loss or damage arising out of circumstances beyond the control of SLD EXPRESS.   • 13- Shipment Carrier Guarantees and Compensations The shipment carrier must indemnify and hold SLD EXPRESS accountable for any loss or damage resulting from the shipper’s failure to comply with the following guarantees and data: 1. All information provided by the shipment carrier or its representatives is complete and accurate; 2) the shipment is acceptable for carriage under Section 2 above; 3.   • 14- Routing The shipment carrier agrees to all routing and forwarding operations, including the possibility of the shipment being transported through intermediate stops.
  • 15- Governing laws Any dispute arising under these terms and conditions or related to them in any way shall, in favor of SLD EXPRESS, be subject to the non-exclusive jurisdiction of the courts, and shall be governed by the law of the country of origin of the shipment and the carrier of the shipment. It is submitted irrevocably to this jurisdiction, unless it conflicts with applicable law.
  • 16- Severability The nullity or unenforceability of any provision does not affect any other part of these terms and conditions.
  • 17- Application These terms and conditions apply to SLD EXPRESS for the benefit of SLD EXPRESS, its authorized agents, its subsidiaries, their office, their directors and their employees.
  • 19-Fulfillment of the request. The beneficiary must pay the service provider as agreed upon in the service contract. C.
